Sir/Mam, In case of renting of commercial property, whether Invoice should be raised within 30 days as per Sec 31(2) i.e. whether Sec 31(2) applies to Renting service ??
2) Which Sec will apply to renting of commercial property– a) Sec 31(2) OR (b) Sec 31(5) ?? Also tell the reason for applicability ??
3) What can be the example for Sec 31(6) [i.e. supply of services ceases under a contract before the completion of the supply]??
1 & 2 In our view renting of commercial property is a continuous supply of services and thus will be subject to Sec 31(5).
3 Example can be situation where supply has started but due to some dispute etc the supply is ceased and thus billing is to made for the work done till ceasing.
