Extend deadlines for Income Tax & GST Audit / Return

GST returns due dates

With the year 2020 coming to end , we have several compliances to make, be it filing of income tax returns or GST returns. Considering the COVID-19 pandemic several professional bodies have been requesting the Government to extend the deadlines of Income Tax and GST.

In this regard Vyyapaar Mandal Association, Nagore & All India MSME and Tax Practitioners Association (AIMTPA) has made a representation to FM for Extension of Due date of GST Annual Returns F.Y. 2018-19 and 2019-20, and Income Tax Return Tax Audits for A.Y. 2020-21 and compliance of Notices.

For ready reference of our readers the Relevant Text of their Representation dated 19.12.2020 is as follows:-

Re:- Extension of Due date of GST Annual Returns F.Y. 2018-19 and 2019-20, and Income Tax Return Tax Audits for A.Y. 2020-21 and compliance of Notices .

With reference to above It is respectfully submitted that due to Covid­19 pandemic the dealers and tax payers are not in a position to consult, visit and meet their Chartered Accountants, Tax Advocates and Tax consultants hence it is not possible for them to compliance the formalities of Tax Audits, GST Annual returns and reply the notices issued by the department. It is a risk of health now to comply these procedures which practically have no substantial revenue effects.

Madam, previously also you were kind enough to extend these dates considering the current situation of Covid-19 but unfortunately the situation is not improved yet hence we all should be careful about the health of our clients and staff.

It is therefore requested to please extend all the above-mentioned dates to 31st March 2021 and oblige.

Representation for extending deadlines of Income Tax by ICAI

It may be noted here that earlier the Institute of Chartered Accountants of India had also requested in the interest of the Nation as a whole, it is once again that the due date of filing return of income u/s 139(1) for all the assessees be suitably extended, to say at least till 31.03.2021, from the current extended due date of 31.12.2020 for AY 2020-21.

It was also requested by ICAI that simultaneously, the ‘specified date’ for filing tax audit reports be extended from 31.12.2020 to say 31.03.2021 as well for AY 2020-21. As statutorily, it may not be possible to have same due dates to file ITR and TAR, then suitable amendment may
be made in section 139 for the same.

It was further requested that, all the other due dates of compliances under Income-tax Act, 1961
(TDS/TCS/Section 11(1A)/54/54F/Advance tax payments etc.) be suitably extended to say
31.03.2021 to enable assessees to meet such deadlines without incurring any other extra
cost.

Representation to extend due dates of GST and Income Tax by BCAS, CAA (Ahmedabad), CAA (Surat), KSCAA & LCAS

In the representation to Finance Minister it was requested that in view of the genuine difficulties faced by tax payers of the country, CBDT may be directed to extend all the deadlines under the
Income-tax Act for AY 2020-21 to 31st March, 2021 and to extend the due dates for FY
2018-19 & 2019-20 under GST Act also to 31st March, 2021.

It was further requested that considering the unprecedented situation that all of us find ourselves in at the moment, there is an urgent need for a notification to be issued immediately for the extension of various due dates. If such announcements of extension are made at the eleventh hour, it causes immense stress and affects the health of all concerned.

It may be noted here that apart from above several other professional bodies like Western Maharashtra Tax Practitioners, Gujarat Sales Tax Bar, Chamber of Tax Consultants, Tax Practitioner’s Association, Indore, AGFTC, ITBC and CAA, Direct Taxes Professionals’ Association, Kolkata, Lucknow CA Tax Practioners’ Association etc have also requested to extend the due dates.

It is expected that Centre may pay heed to their requests and may extend the due dates. However as any extension cannot be guaranteed we should strive for meeting the existing deadlines.
