Bombay High Court grants stay on recovery of interest u/s 50(1) of CGST Act (Read Order)

Bombay High Court in case of Sahara Hospitality v State of Maharashtra AD HOC WP LD-VC NO.112/2020 was pleased to grant unconditional ad-interim stay on recovery of interest under Section 50 of the CGST Act.

The grounds of challenge under this writ petition were that Section 50 is unenforceable and that even otherwise the order of recovery cannot be passed without notice, hearing and any sort of adjudication. Matter is listed on 24th July for reply of State.
