Extend due date GSTR-9/9C filing: Bombay HC asks how Govt. intends to resolve it

Confederation of GST Professionals and Industries also known as CGPI, had moved the Bombay High Court for the due date extension of GSTR-9 (Annual Return) / GSTR-9C (Reconciliation Statement / Audit Certificate) to December 31st, 2020.

The Petition stated the various problems which are being faced by professionals in view of severe restrictions on public transport and staff attendance in many places. Furthermore, petitioner has submitted that Article 21 rights of professionals and their staff are being violated by the manifestly arbitrary and unreasonable decision to give a totally inadequate extension to the time limit.

On behalf of the CGPI, the advocates who appeared stated that the various problems which are being faced by professionals in view of severe restrictions on public transport and staff attendance in many places.

Furthermore, the petitioner has submitted that Article 21 rights of professionals and their staff are being violated by the manifestly arbitrary and unreasonable decision to give a totally inadequate extension to the time limit.

Today Sr Adv Ashok Saraf appeared for Confederation of GST Professionals and Industries in the Writ petition relating to extension of due date for GSTR 9 and 9C in Bombay High Court and made pleas before Bombay HC for benefit of tax professionals.

Court has noted specifically that utility for filing GSTR-9 and 9C for 18-19 was not available till 29.2.2020, there was complete lockdown till 31.5.2020 And thereafter severe restrictions on attendance of staff.

Court has noted his arguments and told the Revenue that this is not adversarial litigation and that solution has to be worked out. Court has called for ASG to appear and tell the Court how the Union of India intends to resolve these matters for benefit of all. Matter is adjourned to 27.10.2020 (High on Board). The Court has specifically said that it will resolve issues if the Government does not figure out any solution.
