GSTR-9 & 9C deadline for FY 18-19 may be extended

The filing of Annual Return in Form GSTR-9 and Audit Certificate / Reconciliation Statement in Form GSTR-9C for the FY 2018-19, was originally required to be filed by 31st December, 2019, as per sub-section (1) and (2) of Section 44 of the CGST Act, 2017.

However the due date of filing above was extended last upto 30th September,2020 vide Notification No. 41/2020-Central Tax dated 5th May, 2020.

Several Trade and Industry Representations made to the Govt. to extend deadline of 30th September, 2020, noting COVID-19 hardships. The Institute of Chartered Accountants of India had also written to the GST Council seeking deferment of 2018-19 GST annual return by 3 months till December, 31. However no formal announcement or any Notification has been issued in this regard till now with only five days left.

In this regard as per the tweet of CNBC TV18 , the GST Implementation Committee is considering to extend GSTR-9 & GSTR-9C for FY 2018-19 deadline by one month. However it has been stated in the tweet that GST implementation Committee is yet to take a formal decision in this regard.

A one month extension would mean the deadline for filing of GSTR-9 and GSTR-9C will shift from 30th September, 2020 at present to 31st October,2020. However formal decision for extension is still pending and lets wait for any formal announcement / issuance of Notification in this regard.

However in our view decision in this regard should be made at the earliest as only five days are left from the existing deadline and in case any relief is accorded to tax payers same should be intimated in a timely manner.
