Prior to GST, we had a uniform maintenance charge per sft, as per our Bye-laws. After GST was introduced, RWA fixed two rates , one for GST- paying apartments and a higher rate for GST-not paying apartments. The reasons given for the higher rate for GST-not-paying apartments is that they have to pay the input GST paid to vendors by the association and GST-paying apartments do not have to pay that input GST as they are eligible for GST input credit.

You can provide ITC relief. there is absolutely no impediment under GST Law.
